The Zoning Board of Appeals is comprised of five members, to serve for overlapping five-year terms. The Chairman shall be one of the five members and shall be designated as such by the Town Board annually. Vacancies shall be filled in like manner; provided, however, an unexpired term shall be filled for such unexpired term only. The Zoning Board of Appeals has jurisdiction over residential and commercial special use permits and variances; and interprets the zoning code as set forth in regulations found within Chapters 161 (Zoning) and A167 (Zoning Board of Appeals Rules and Regulations) of the Waterford Town Code. Meetings are held on the third Tuesday of every month at Town Hall at 6:30 PM.

Below are excerpts from the Town of Waterford code, specifically those that Town Planning and the Town Planning Board adhere to.
This chapter shall apply to the appointment, terms, functions and powers of alternate members appointed to serve on the Planning Board and Zoning Board of Appeals in the Town of Waterford.
For the purpose of promoting the public health, safety, morals, comfort and general welfare; conserving and protecting property and property values; securing the most appropriate use of land; lessening or avoiding congestion in the public streets and highways; and facilitating adequate but economical provision of public improvements, all in accordance with a Comprehensive Plan, the Town Board finds it necessary and advisable to regulate the location, size and use of buildings and other structures; percentages of lot area which may be occupied; setback building lines; sizes of yards, courts and other open spaces; and the use of land for trade, industry, residences, recreation or other purposes, and for such purpose, divides the unincorporated area of the Town into districts or zones. Said districts are bounded and defined as shown on a map entitled "Zoning Map of the Town of Waterford, Saratoga County, New York," adopted February 2, 2004, and certified by the Town Clerk, which accompanies as Appendix A and which with all explanatory matter thereon, is hereby made a part of this chapter.
